A South African High Court Apostille is a certification that authenticates the origin of a public document for use in another country. This process is part of the Hague Apostille Convention, which simplifies the legalisation of documents to be recognized internationally in any of the 126 foreign countries that are a member of the Hague Apostille Convention.

The apostille serves as proof that the document in question is an official document with a verified government signature and ensures that this will be accepted in your destination country for official use.

Please Note: A number of countries (like the UAE, Thailand and Egypt) are not members of the Hague convention. If your document is intended for that country then after the High Court apostille is done it will need to be sent to DIRCO for an additional Certificate of Authentication, not an apostille, and they often requite an extra legalisation step at this country’s embassy. You can do this yourself or we can provide a custom quote for this.

How To Apply For Your High Court Apostille and Notarisation

  1. Download the application form, complete it, scan it and email it to us along with a copy of your ID or Passport and scans of the documents that you would like to be notarised and apostilled by the High Court..
  2. We will then send you an invoice with payment instructions, and you will courier the documents to our Johannesburg offices (we can arrange collection if you are in South Africa)
  3. Once we receive the documents and payment we will submit your documents to get a notarised copy made and submitted to the High Court the next day and confirm submission with you.
  4. We follow and ensure that everything is being processed and once the High Court has completed the process we collect it the following business day.
  5. We send you a high resolution scan of the legalised documents to ensure that all the details are correct and for your peace of mind.
  6. Once you have confirmed that all details are correct we will send it for further legalisation steps if you have chosen those options, otherwise we courier it directly to you. Local courier takes 1 business day, worldwide courier takes 45 days.

The process
  1. Document Preparation: A copy of the document is made in the presence of a notary public and that copy is then notarised
  2. Certification by the High Court: The document is then taken to the High Court in South Africa where it is authenticated. The High Court verifies the signature, stamp, or seal on the document by the notary.
  3. Apostille Issuance: Once the High Court has authenticated the document, an apostille certificate is attached to it. This certificate verifies the authenticity of the document and is recognized by countries that are members of the Hague Apostille Convention.
  4. International Use: With the apostille certificate attached, the document can be used in any other country that is a member of the Hague Apostille Convention without the need for further authentication.

If the documents are being used for a country not in the Hague convention they can then be afterwards sent to DIRCO for legalisation and issues with a Certificate of Authentication instead of an apostille.

What is the difference between a apostille and notarisation?

A notarised document is a copy of a document which is certified by an attorney registered at The High Court. This just confirms that it is a copy of the original document without alterations. This notarised copy can be apostilled at the High Court

A DIRCO apostille to a document means that it was authenticated as having been issued and signed by a specially appointed government official. In South Africa the Apostille is issued by The Department of International Relations and Co-operation otherwise known as DIRCO

What is the difference between a DIRCO apostille and a High Court apostille?

A DIRCO apostille is a certificate that has been authenticated for use by DIRCO in any one of the 126 countries that are part of the Hague convention. An apostilled certificate will be accepted by any of those countries without having to go through any additional steps

A Certificate of Authentication is issued on a document if it is intended for a country that is not part of the Hague Apostille Convention. In this case the document will often need to be further attested at that country’s embassy in order to be used in that country. High court apostilles that need to be further legalised for use in countries must be sent to DIRCO for a further certificate of authentication before being sent to that country’s embassy.

Do apostilles have an expiry date?

Apostilles don’t have an expiration date and never expire. However, some countries might ask for an apostille that is no older than 3, 6, or 12 months. This isn’t required by the Hague Convention or any law, and many places will accept an apostille years after it was issued.

It makes sense for there to be time restrictions on certain apostilled documents like Police Clearance certificates where the actual certificate is only valid for 6 months. Please check with your embassy or local government authority to check if they have requirements for apostilles to be issued within a set period

What is embassy attestation?

For countries that are not part of the Hague convention, documents that have been issued with a High Court apostille need to then be sent to DIRCO where they are issued with a Certificate of Authentication confirming their authenticity. This certificate then needs to go through an additional process by being attested at that country’s embassy.
